Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

O presente artigo apresenta resultados de uma pesquisa que enfocou a avaliação de desempenho (AD) como um instrumento de poder utilizado na gestão de pessoas. Realizou-se um estudo de caso que utilizou entrevistas individuais com 14 participantes, sendo 4 diretores e gerentes e 10 trabalhadores da área administrativa e operacional. Para análise dos dados, utilizou-se a análise gráfica do discurso de Lane (1985). A análise dos dados indicou que os participantes (diretoria) percebiam as políticas de gestão de pessoas permeadas pela (...) ideologia dominante como uma forma de garantir a competitividade da empresa no mercado. Já os trabalhadores a percebiam como a possibilidade para o desenvolvimento profissional e a promoção. Os dados sugerem que os resultados da AD eram utilizados na gestão de pessoas apenas quando sustentavam/confirmavam as práticas e decisões da diretoria relacionadas às políticas de pessoal. Assim, a AD pode ser considerada um instrumento de poder na gestão de pessoas, porém tendo seu uso limitado a fatores externos à técnica quando subsidia as ações dos diretores. (shrink)

This paper presents Integrated Information Theory (IIT) 4.0. IIT aims to account for the properties of experience in physical (operational) terms. It identifies the essential properties of experience (axioms), infers the necessary and sufficient properties that its substrate must satisfy (postulates), and expresses them in mathematical terms. In principle, the postulates can be applied to any system of units in a state to determine whether it is conscious, to what degree, and in what way. IIT offers a parsimonious explanation of (...) empirical evidence, makes testable predictions, and permits inferences and extrapolations. IIT 4.0 incorporates several developments of the past ten years, including a more accurate translation of axioms into postulates and mathematical expressions, the introduction of a unique measure of intrinsic information that is consistent with the postulates, and an explicit assessment of causal relations. By fully unfolding a system's irreducible cause-effect power, the distinctions and relations specified by a substrate can account for the quality of experience. (shrink)

A busca recuperou 80 artigos, dos quais 50 demonstraram aderência ao estudo. The philosophy of Bernard Williams, recognised as a prominent expression of ethical thought, presents an intense dialogue with ancient Greek tragic culture. Combining erudition and elegance, Williams evokes Greek tragedies to discuss modern ethical ideas and conceptions. Our article intends to consider Williams’ thought from a cultural point of view: we propose analysing Williams’ cultural methodology, which may be described as a way of thinking beyond the traditional dichotomies between the ancient and the modern, especially concerning the notion of the (...) tragic. Accordingly, we shall examine the affinities between ancient and modern tragic cultures by identifying common narrative and poetical elements. To do so, we shall consider the interpretation of Hamlet, developed by the classicist scholar H.D.F. Kitto. In Form and Meaning in Drama: A Study of Six Greek Plays and of “Hamlet” (1956), Kitto proposes reading Hamlet in close alliance with Oedipus Tyrannus. Kitto maintains that both tragedies are poetical expressions of a shared tragic element: miasma, or “pollution”, a concept thoroughly treated by Williams in the third chapter of Shame and Necessity. Our article aims to combine Williams’ cultural methodology—we may call it the deconstruction of the repeated theoretical frameworks regarding the differences between the ancient and the modern—and Kitto’s reading of Hamlet in line with Oedipus Tyrannus, which may be understood as an illustration of the persistence of common tragic elements beyond time and the historical separation of cultural periods. Our perspective shall be both cultural and aesthetical. (shrink)

RESUMEN Partiendo de la discusión del concepto de carne, en este trabajo analizo la común estructura ontológica/biopolítica que comparten los animales humanos y no humanos. Para ello me sirvo de los feminismos materiales y utilizo los hallazgos teóricos del feminismo animalista. También examino la noción de "encierro" en tanto concepto biopolítico que produce un nuevo tipo de ser vivo. Todo ello para, en último lugar, articular un sentido positivo del concepto de encarnación que permita construir comunidad animal. ABSTRACT In this (...) article, I analyze the common ontological/biopolitical structure shared by human and non-human animals, starting out from the discussion of the concept of flesh. To that effect, I resort to material feminisms and to the theoretical findings of animal rights feminism. I also examine the notion of "enclosure" as a biopolitical concept that produces a new kind of living being. All of this serves to formulate a positive sense of the concept of incarnation that allows for the construction of a animal community. (shrink)

Is evidential support transitive? The answer is negative when evidential support is understood as confirmation so that X evidentially supports Y if and only if p(Y | X) > p(Y). I call evidential support so understood “support” (for short) and set out three alternative ways of understanding evidential support: support-t (support plus a sufficiently high probability), support-t* (support plus a substantial degree of support), and support-tt* (support plus both a sufficiently high probability and a substantial degree of support). I also (...) set out two screening-off conditions (under which support is transitive): SOC1 and SOC2. It has already been shown that support-t is non-transitive in the general case (where it is not required that SOC1 holds and it is not required that SOC2 holds), in the special case where SOC1 holds, and in the special case where SOC2 holds. I introduce two rather weak adequacy conditions on support measures and argue that on any support measure meeting those conditions it follows that neither support-t* nor support-tt* is transitive in the general case, in the special case where SOC1 holds, or in the special case where SOC2 holds. I then relate some of the results to Douven’s evidential support theory of conditionals along with a few rival theories. (shrink)

We develop and apply a multi-dimensional conception of explanatory depth towards a comparative analysis of inflationary and bouncing paradigms in primordial cosmology. Our analysis builds on earlier work due to Azhar and Loeb (2021) that establishes initial condition fine-tuning as a dimension of explanatory depth relevant to debates in contemporary cosmology. We propose dynamical fine-tuning and autonomy as two further dimensions of depth in the context of problems with instability and trans-Planckian modes that afflict bouncing and inflationary approaches respectively. In (...) the context of the latter issue, we argue that the recently formulated trans-Planckian censorship conjecture leads to a trade-off for inflationary models between dynamical fine-tuning and autonomy. We conclude with the suggestion that explanatory preference with regard to the different dimensions of depth is best understood in terms of differing attitudes towards heuristics for future model building. Some philosophers have recently argued that decision-makers ought to take normative uncertainty into account in their decisionmaking. These philosophers argue that, just as it is plausible that we should maximize expected value under empirical uncertainty, it is plausible that we should maximize expected choice-worthiness under normative uncertainty. However, such an approach faces two serious problems: how to deal with merely ordinal theories, which do not give sense to the idea of magnitudes of choice-worthiness; and how, even when theories do give (...) sense to magnitudes of choice-worthiness, to compare magnitudes of choice-worthiness across different theories. Some critics have suggested that these problems are fatal to the project of developing a normative account of decision-making under normative uncertainty. The primary purpose of this article is to show that this is not the case. To this end, I develop an analogy between decision-making under normative uncertainty and the problem of social choice, and then argue that the Borda Rule provides the best way of making decisions in the face of merely ordinal theories and intertheoretic incomparability. The debate over the existence of a “public sphere” in China’s Late Qing/Early Republican era began nearly three decades ago, but it has yet to generate a special socio-cultural review on the “Confucian social imaginary” of the Chinese people. The article builds on existing “economic-political approach” and “idea-communication approach” to argue decisive factors hindering the development of a Habermasian “public sphere.” These includes (1) people’s traditional-collectivist lifestyle, (2) lack of understanding of “universal equality,” (3) conservative self-positioning during social transition, (4) (...) regionalist attitude toward outsiders, (5) lack of access to Enlightenment ideas, (6) disregard for parliamentary systems, and (7) ignorance of the rule of law. Although declarations of the death of God seem to be provocations announcing the end of the era of theology, this announcement is actually central to the Christian revelation in its most classic forms, as well as to its reworkings in contemporary religious thought. Indeed provocative new possibilities for thinking theologically open up precisely in the wake of the death of God. Already Hegel envisaged a revolutionary new realization of divinity emerging in and with the secular world through its establishment of (...) a total order of immanence. However, in postmodern times this comprehensive order aspired to by modern secularism implodes or cracks open towards the wholly Other. A hitherto repressed demand for the absolute difference of the religious, or for “transcendence”, returns with a vengeance. This difference is what could not be stated in terms of the Hegelian System, for reasons that poststructuralist writers particularly have insisted on: all representations of God are indeed dead. Yet this does not mean that they cannot still be powerful, but only that they cannot assign God any stable identity. Nietzsche’s sense of foreboding concerning the death of God is coupled with his intimations of the demise of representation and “grammar” as epistemologically bankrupt, but also with his vision of a positive potential for creating value in the wake of this collapse of all linguistically articulated culture. He points the way towards the emergence of a post-secular religious thinking of what exceeds thought and representation. (shrink)

Two controversial cases in Confucian literature present the demands of filial piety as conflicting with those of impartial justice. Let us call them the Case of Concealment (Analects 18.13) and the Case of Evasion (Mencius 7A53). A dogmatic reading of the texts indicates that both Confucius and Mencius give more weight to filial piety than to justice. This essay, however, provides an alternative reading of the cases: the liberal reading. I argue that the Confucian teachers used the cases as moral (...) dilemmas that force Confucian students to learn how to use a cluster of Confucian virtues, including practical wisdom, discretion, and straight determination, under difficult circumstances. The liberal reading views these moral dilemmas as rhetorical tools; they guide Confucian students in meditative exercises and ultimately transform students’ mode of seeing and being. (shrink)

A major problem for interpersonal aggregation is how to compare utility across individuals; a major problem for decision-making under normative uncertainty is the formally analogous problem of how to compare choice-worthiness across theories. We introduce and study a class of methods, which we call statistical normalization methods, for making interpersonal comparisons of utility and intertheoretic comparisons of choice-worthiness. We argue against the statistical normalization methods that have been proposed in the literature. We argue, instead, in favor of normalization of variance: (...) we claim that this is the account that most plausibly gives all individuals or theories ‘equal say’. To this end, we provide two proofs that variance normalization has desirable properties that all other normalization methods lack, though we also show how different assumptions could lead one to axiomatize alternative statistical normalization methods. In this book William G. Lycan offers an epistemology of philosophy itself, a partial method for philosophical inquiry. The epistemology features three ultimate sources of justified philosophical belief. First, common sense, in a carefully restricted sense of the term-the sorts of contingentpropositions Moore defended against idealists and skeptics. Second, the deliverances of well confirmed science. Third and more fundamentally, intuitions about cases in a carefully specified sense of that term. The first half of On Evidence in Philosophy expounds a (...) version of Moore's method and applies it to each of several issues. This version is shown to resist all the standard objections to Moore; most of them do not even apply. It is argued, in Chapters 5 and 6, that philosophical method is far lesspowerful than most have taken it to be. In particular, deductive argument can accomplish very little, and hardly ever is an opposing position refuted except by common sense or by science. The final two chapters defend the evidential status of intuitions and the Goodmanian method of reflectiveequilibrium; it is argued that philosophy always and everywhere depends on them. The method is then set within a more general explanatory-coherentist epistemology, which is shown to resist standard forms of skepticism.In sum, William G. Lycan advocates a picture of philosophy as a very wide explanatory reflective equilibrium incorporating common sense, science, and our firmest intuitions on any topic-and nothing more, not ever. The Gifford Lectures were established in 1885 at the universities of St Andrews, Glasgow, Aberdeen and Edinburgh to promote the discussion of 'Natural Theology in the widest sense of the term - in other words, the knowledge of God', and some of the world's most influential thinkers have delivered them. The 1901–2 lectures given in Edinburgh by American philosopher William James are considered by many to be the greatest in the series. The lectures were published in book form in (...) 1902 and have been reprinted many times. James, who was educated in the United States and Europe, and spent much of his career teaching philosophy at Harvard, was very influential in the development of modern psychology, and in these twenty lectures he explores the personal experience of religion. William Jaworski shows how hylomorphism can be used to solve mind-body problems--the question of how thought, feeling, perception, and other mental phenomena fit into the physical world. Hylomorphism claims that structure is a basic ontological and explanatory principle, and is responsible for individuals being the kinds of things they are, and having the powers or capacities they have. From a hylomorphic perspective, mind-body problems are byproducts of a worldview that rejects structure, and which lacks a basic principle which distinguishes (...) the parts of the physical universe that can think, feel, and perceive from those that can't. Without such a principle, the existence of those powers in the physical world can start to look inexplicable and mysterious. But if mental phenomena are structural phenomena then they are uncontroversially part of the physical world. Hylomorphism thus provides an elegant way of solving mind-body problems. (shrink)

This volume, the latest in the Minnesota Studies in the Philosophy of Science series, explores what a scientific metaphysics grounded in biological practices could look like and how it might impact the way we investigate the world around us. From Biological Practice to Scientific Metaphysics examines how to reconcile the methods of biological practice with the methods of metaphysical cosmology, notably regarding (...) the origins of life. Cognitivism is now rather clearly the dominant approach in psychology. Philosophers such as Putnam (1975), Dennett (1978), Lycan (1981), and Cummins (1983) have supported the cognitivist strategy by proposing that mental states are to be defined functionally in terms of their interactions with other mental states. One of the most prominent features of the cognitivist-functionalist position is the autonomy it is thought to bestow upon psychology. Psychology, as viewed from this perspective, describes the processing of mental representations within the mind-brain (...) and does not need to concern itself with the neurological activity that underlies its operation.The arguments that are raised to support the autonomy of psychology from neurophysiology are arguments against a strong reductionist position that makes psychology dispensable (a view held, for example, by P.S. Churchland (1980)). The arguments are designed to show that there are regularities in nature that are not captured in the laws of physics. (shrink)

This article approaches the issue of Matthew’s theological context by examining Matthew’s use of Mark, including through redaction and supplementation, in Matthew 1–4. This is undertaken in two parts: Matthew 1–2, which is largely additional material, and Matthew 3–4, followed by a concluding assessment. Issues addressed or alluded to in these chapters frequently find resonance in the remainder of Matthew’s gospel and so give important clues about Matthew’s concerns and their relevance for understanding its context. Such issues include the importance (...) of messiahship; continuity with Israel, but also with John the Baptist and the Church; defence against slander; heightened christological claims; soteriology; Gentile mission; the status of Torah; and Jesus as judge to come. The article suggests a location within a Jewish religious context with a Jewish self-understanding, separate from the synagogue, but claiming to belong where its opponents would claim it did not; and a Christian tradition where the approach of ‘Q’ to Torah is upheld in contrast to Mark’s, while embracing and expanding Mark’s Christology and restoring the common understanding of Gentile mission as a post- Easter phenomenon. You are, I am sure, just as aware as I am that the operational nodes of a complex problem, the points at which it can be split open to yield nuggets of new insight or achieve lasting advances, often lie in tediously technical details perhaps incomprehensible to all but specialists in the matter and anyways totally lacking in the romance and easy excitement which attract the topic's dilettantes. I would like you to hold fast to this appreciation, for the concerns (...) I shall raise here are technical indeed. They are, however,seminaltechnicalities which, as we seek to fathom them, should fundamentally reshape our comprehension of the logic of confirmation, causal connectedness, and the foundations of statistical inference. In brief, it will be seen that certain powerful everyday intuitions concerning which propositions are confirmationally irrelevant to which others are exceedingly difficult to justify. (shrink)

In this paper we consider the potential role of metarepresentation—the representation of another representation, or as commonly considered within cognitive science, the mental representation of another individual's knowledge and beliefs—in mediating definite reference and common ground in conversation. Using dialogues from a referential communication study in which speakers conversed in succession with two different addressees, we highlight ways in which interlocutors work together to successfully refer to objects, and achieve shared conceptualizations. We briefly review accounts of how such shared conceptualizations (...) could be represented in memory, from simple associations between label and referent, to “triple co-presence” representations that track interlocutors in an episode of referring, to more elaborate metarepresentations that invoke theory of mind, mutual knowledge, or a model of a conversational partner. We consider how some forms of metarepresentation, once created and activated, could account for definite reference in conversation by appealing to ordinary processes in memory. We conclude that any representations that capture information about others' perspectives are likely to be relatively simple and subject to the same kinds of constraints on attention and memory that influence other kinds of cognitive representations. The contribution of Jesuits to the different fields of knowledge, including philosophy, is historically well known. In fact, since the foundation of the Society of Jesus, in the 16th century, Jesuits from different generations and cultures have taken part in the philosophical debates of their time and their different contexts. Since the foundation of the Society of Jesus, in 1540, the Jesuits, individually and as a body, have engaged in a fruitful dialogue between the Christian tradition and different dimensions of (...) human culture. During almost five centuries, numerous Jesuits taught philosophy in academic institutions all over the world. Some of them have their names recorded in the history of philosophy. Of course, the majority of them is not anymore remembered, despite their valuable contribution to the development of the Jesuit intellectual tradition up to our times. In fact, as an heir of the Roman College, the first academic institution founded by the Society of Jesus, in 1551, the Pontifical Gregorian University, in Rome, is a witness to this tradition, which has been kept alive thanks to the discrete work of both Jesuits and lay intellectuals. Known as the University of the Nations, this institution corroborates not only the capacity of the Jesuit tradition to put faith in dialogue with reason, but also the option to take the concrete reality of each human culture and its historical context as its point of departure. The Jesuits’ willingness to engage in dialogue with different intellectual perspectives is underpinned by one of the most defining traits of the Jesuit charism, namely, the conviction that God can be found and served in all things. Accordingly, Jesuits have adopted, from the beginning, an amenable stance towards the world with its different cultures and intellectual trends. As such, Jesuits have, since the beginning, inhabited the frontiers of human thought. According to the contemporary philosopher Paul Gilbert, SJ, within the institutions under the leadership of the Society of Jesus, it was always possible to maintain an equilibrium between two principles: “intellectual unity” and “openness to the world.” Without detriment to the Jesuit identity, the companions of Ignatius have been willing to dwell in the various dimensions of human reality, in their multiplicity and plurality. Either in the renewal of Aristotle’s and Aquinas’ metaphysics, or in the dialogue with modern philosophers such as Descartes, Kant, or Hegel, and even in the inculturation in non-European contexts, the Jesuits have been able to preserve the Christian tradition through an original development of human culture in all its richness and diversity. With respect to the last century, it has to be acknowledged that a significant number of Jesuits made significant contributions, with recognized competence, to philosophy. Certainly, the 20th century was particularly complex in many respects. It would be enough to recall that this period, which brought with it unprecedented social, scientific, and technological developments, was also the stage for the two World Wars. With the emergence or consolidation of philosophical currents such as Marxism, Phenomenology, Existentialism, Structuralism, and Post-Modernism, the past century was, without any doubt, fascinating from the intellectual point of view. Jesuits such as Karl Rahner, Frederick Copleston, Bernard Lonergan, William Norris Clarke, John F. Kavanaugh, Teilhard de Chardin, Gaston Fessard, Jean Daniélou, Henri de Lubac, Michel de Certeau, Xavier Tilliette, Paul Valadier, Paweł Siwek, Ignacio Ellacuría, Francisco Taborda, Henrique de Lima Vaz and, in the Portuguese context, Diamantino Martins or Júlio Fragata, among many others, were able to engage different philosophical currents, problems and controversies of their times. Faithful to their long tradition of being present in the frontiers of thought, those Jesuits have engaged in a fruitful dialogue with these intellectual trends, offering relevant contributions to different ongoing debates. Within this context, the present volume recalls and discusses the philosophical contribution of some of the most prominent Jesuit protagonists of the intellectual interchange that took place in the 20th century. This volume also intends to celebrate the 75th anniversary of the Revista Portuguesa de Filosofia, which happens just before the inauguration of the Ignatian Year. Decreed by Father Arturo Sosa, the Superior General of the Society of Jesus, this celebratory Year will start on May 20, 2021, precisely 500 years after Ignatius of Loyola, the founder of the Jesuit Order, was wounded at the battle of Pamplona. We are happy that this volume could bring together outstanding specialists in the thought of some of the most prominent Jesuits philosophers of the last century, namely Paul Valadier, Paul Gilbert, Józef Bremer, Jacek Poznański, Alexander Maar, Patrick H. Byrne, M. Ross Romero, Carlos Alvarez, Hélio Pereira Lima, José Gama, Domingos Terra, Gabriel Flynn, Marie-Gabrielle Lemaire, José Sols Lucia, Lorena Zuchel Lovera, Pedro Pablo Achondo Moya, Enzo Solari, Massimo Borghesi, Mendo Castro Henriques, João Barbosa, and Dominique Lambert. In addition, in the celebration of the 100th anniversary of Júlio Fragata’s birth, Maria Teresa Fragata presents a memory of his life and thought. We hope that this volume may be useful to all those interested in the Jesuit philosophical tradition. Hopefully, it will stimulate scholars to pursue a fruitful and creative dialogue with contemporary philosophy, in the footsteps of the Jesuit philosophers featured here. Based on a qualitative study, this paper explores how United States public health professionals view and think about the existing U.S. healthcare system, while also allowing these study participants to imagine new ways of structuring and practicing public health. Using semi-structured qualitative interviews, I show how public health professionals engage with the concept of “the social” and their personal experiences with public health to question the status quo. By giving public health professionals space in which to imagine changes and different (...) ways of practicing public health, I demonstrate the effectiveness of imagination as a capacity that public health professionals possess to take the lead in creating the changes they hope for. Autobiography and Teacher Development in China investigates the roles of autobiography in teacher education, as several scholars in China recontextualize Western conceptions of teacher development, combining them with uniquely Chinese cultural conceptions to articulate a reconceptualization of teacher development that holds worldwide significance. Framed by the work of Zhang Hua and William F. Pinar, these theoretical and practical essays point to an internationally inflected reconceptualization of teachers' professional development, pre-service and in-service. William Galston is a distinguished political philosopher whose work is informed by the experience of having also served from 1993–5 as President Clinton's Deputy Assistant for Domestic Policy. He is thus able to speak with an authority unique amongst political theorists about the implications of advancing certain moral and political values in practice. The foundational argument of this 2002 book is that liberalism is compatible with the value pluralism first espoused by Isaiah Berlin. William Galston defends a version (...) of value pluralism - liberal pluralism - and argues, against the contentions of John Gray and others, that it undergirds a kind of liberal politics that gives weight to the ability of individuals and groups to live their lives in accordance with their deepest beliefs about what gives meaning and purpose to life. The field of AI safety aims to prevent increasingly capable artificially intelligent systems from causing humans harm. Research on moral alignment is widely thought to offer a promising safety strategy: if we can equip AI systems with appropriate ethical rules, according to this line of thought, they'll be unlikely to disempower, destroy or otherwise seriously harm us. Deontological morality looks like a particularly attractive candidate for an alignment target, given its popularity, relative technical tractability and commitment to harm-avoidance principles. I (...) argue that the connection between moral alignment and safe behavior is more tenuous than many have hoped. In general, AI systems can possess either of these properties in the absence of the other, and we should favor safety when the two conflict. In particular, advanced AI systems governed by standard versions of deontology need not be especially safe. (shrink)

It has recently been suggested that research in neuroscience of art has failed to bring art into focus in the laboratory. Two general arguments are brought to bear in the regard. The common perceptual mechanisms argument observes that neuroscientists working within this field develop models to explain art relative to the ways that artworks are fine-tuned to the operations of perceptual systems. However, these perceptual explanations apply equally to how viewers come to recognize and understand art and nonart objects and (...) events. Therefore these explanations fail to disambiguate artworks from other things. They fail to locate art. This observation points to a deeper problem. What interests us in art is how what we perceive has been used to show us what the work represents. Our understanding of art is governed by a range of productive and evaluative normative conventions that govern how we ought to look at a work and evaluate how it was made. The normative dimension of appreciation argument suggests that these aspects of our engagement with artworks lie outside the scope of neuroscientific explanations of art. This chapter provides a sketch of a diagnostic recognition framework for engaging art that resolves both problems and helps explains how artworks function within the social institution of the artworld to facilitate a communicative exchange between artists and consumers.
